TERMS OF SERVICE

These Terms of Service govern your use of draindk.tech and any purchase made from DRAIN DK. By visiting the site, placing an order, or using a digital product, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site or purchase a product.

1. STORE ACCESS

You must be old enough to enter a binding agreement in your country. You are responsible for providing accurate account, billing, and contact information and for protecting any account credentials you use.

2. PRODUCTS, PRICES, AND ORDERS

Product descriptions, previews, prices, and availability may change. Prices are displayed in the currency selected for your market where supported. Taxes and payment charges may be added where required. We may refuse or cancel an order affected by fraud, technical error, incorrect pricing, or unlawful activity. If payment has already been captured for a cancelled order, the relevant amount will be returned.

3. DIGITAL DELIVERY

Digital products are normally delivered through a download link or the delivery method shown at checkout. You are responsible for entering a working email address and for storing your downloaded files safely. If delivery fails or a file is defective, contact us so the delivery can be repaired.

4. PRODUCT LICENCES

A purchase gives you a licence to use the digital product. It does not transfer ownership of the source files, recordings, artwork, brand, or underlying intellectual property.

The licence stated on the product page or included with the files controls how that product may be used. Unless that licence expressly says otherwise, the licence is personal, limited, non-exclusive, non-transferable, and may be revoked if these Terms are materially breached.

Finished music releases are supplied for personal listening only unless separate written permission is provided. Sound libraries, samples, and production tools may be used only within the creative scope stated in the relevant product licence.

You may not share, re-upload, redistribute, resell, rent, sublicense, repack, or make the source files available as standalone files, in another sample pack, in a shared library, or through a competing product. You may not claim the source files themselves as your exclusive work.

5. INTELLECTUAL PROPERTY

The site and its content, including audio, artwork, graphics, text, product names, and design elements, are protected by applicable intellectual property laws. Rights remain with DRAIN DK, WHATDYINGFEELSLIKE, or the relevant rights holder. No right is granted except the limited product licence described above.

6. CANCELLATIONS AND REFUNDS

Digital products are supplied immediately. Where permitted by law, cancellation or withdrawal rights may be limited once delivery or download begins with your consent. Nothing in these Terms removes any mandatory consumer right that applies to you. If a file is defective, materially different from its description, or cannot be delivered, contact us and we will assess repair, replacement, or refund as required by law.

7. ACCEPTABLE USE

You may not misuse the site, attempt unauthorised access, interfere with its operation, transmit malicious code, scrape it for unlawful purposes, or use the Services in a way that violates another person's rights or applicable law.

8. AVAILABILITY AND ACCURACY

We work to keep the site and product information accurate, but minor errors, interruptions, or compatibility differences may occur. Before purchase, you are responsible for checking the stated file formats, software requirements, and product details. We may correct errors and update or discontinue content where reasonably necessary.

9. THIRD-PARTY SERVICES

The store uses Shopify and may use payment, delivery, analytics, streaming, or social platforms operated by third parties. Their own terms and privacy practices may apply. Purchases from DRAIN DK are made with DRAIN DK, not with Shopify. Links to third-party services are provided for convenience and do not make us responsible for their independent content or operation.

10. PRIVACY

Our handling of personal information is described in the Privacy Policy. Shopify may also process information needed to operate the store and checkout.

11. DISCLAIMERS AND LIABILITY

To the maximum extent permitted by law, the site and digital products are provided without guarantees beyond those expressly stated or required by law. We are not liable for indirect, incidental, or consequential loss arising from use of the site or a product. Nothing in these Terms excludes liability that cannot legally be excluded, including mandatory consumer protections.

12. INDEMNITY

You are responsible for losses or claims caused by your unlawful use of the site, your unauthorised redistribution of a product, or your material breach of these Terms, to the extent permitted by applicable law.

13. GOVERNING LAW

These Terms are governed by Danish law, without removing any mandatory protection available to a consumer in their country of residence. Disputes should first be raised with us in good faith. Courts with lawful jurisdiction may hear any unresolved dispute.

14. CHANGES TO THESE TERMS

We may update these Terms when the store, products, or legal requirements change. The current version and its update date will be posted on this page. Material changes apply from the stated effective date.
